I represent consumer and small business debtors in bankruptcy and debt reorganization. Chapter 7 bankruptcy is for people who cannot repay their debts and discharges or legally eliminates most debts. Chapter 13 is for people who have some ability to repay their debts but not the way their creditors want them to. It is also used to easily repay debts that do not discharge in bankruptcy, such as some taxes and support payments. Chapter 13 also allows a better repayment of auto loans or past due payments on real estate to stop a foreclosure.
