As with all criminal charges, the State must meet its burden and prove every element of the charged offense beyond a reasonable doubt. Often, there will be weaknesses in the State's case, based on improperly obtained evidence, improper traffic stops or errors committed by the arresting police officer during the course of the arrest or during the administration of a breath test. These weaknesses make it harder for the State to prove every element of the charged offense beyond a reasonable doubt and can result in the charges being reduced or dismissed altogether. If a favorable plea agreement cannot be reached, I will be prepared to present an aggressive and effective defense at trial.
