After death, a will is an important document that determines how your property will be distributed. Whether you have a will or not, a court proceeding will be necessary if you owned real property in your own name or if the value of your personal property such as bank accounts, vehicles, stocks, etc., exceeds a certain amount.
The probate court also deals with guardianship. I handle guardianship cases for adults with physical or cognitive impairments such as dementia or developmental disabilities. I also handle guardianship cases for children in limited situations mostly dealing with their inability to own property that they inherit.
I take pride in my extensive experience in working with developmentally disabled adults and their families. I have handled over 100 guardianship cases for these families. I can also help prepare a special needs trust for individuals receiving SSI or Medicaid benefits to prevent any future loss of benefits should they receive a monetary distribution or inheritance.
