Lawyer Overview
A former general counsel at the Commerce Department, deputy general counsel at the Treasury Department, and deputy associate attorney general at the Justice Department, Lily Fu Claffee advises major corporations and their executives in litigation, regulatory, investigative, and enforcement matters involving federal and state governments. In addition to handling matters involving national security and trade controls (EAR, ITAR, OFAC, NISPOM), Lily regularly served as the lead lawyer supporting Treasury's and Commerce's membership on the Committee on Foreign Investment in the United States (CFIUS) and was a primary architect of regulations implementing the Foreign Investment National Security Act of 2007 (FINSA).
A litigator with more than 15 years' experience in complex commercial, class action, antitrust, and appellate matters, Lily headed the Commerce Department's 400-attorney law division that advises 10 agency components, including the Bureau of Industry & Security (BIS). Prior to Commerce, Lily was the second-ranking legal officer at the Treasury Department, where, as a member of Secretary Henry M. Paulson's executive team, she managed the agency's 2,000-lawyer legal unit. At Treasury, Lily handled a wide variety of issues, including matters involving the Office of Foreign Asset Control (OFAC) and federal financial stability efforts. At the Justice Department, Lily served in a leadership office overseeing the agency's civil litigating components, including the antitrust and civil divisions.
Prior to working in government, Lily was a litigation partner in a major law firm in Washington, D.C. She speaks Chinese in the Cantonese dialect.
