Since entering private practice, Mr. Kinsel has been actively involved in trials, mediations and arbitrations throughout the United States, representing victims of the negligent and intentional acts of others. He has handled a vast array of legal matters and has personally tried cases involving products liability, negligence, admiralty, and gross negligence. PATENT INFRINGEMENT - SETTLEMENT & LICENSING AGREEMENT

Civil Action No. 9:07cv70; E-Watch, Inc. v. Matsushita Electric Industrial Co., Ltd., Panasonic Digital Communications and Security Company and Panasonic Corporation of North America; In the United States District Court for the Eastern District Texas. Moore Landrey LLP represented the Plaintiff / Inventor in this patent infringement case involving security devices. Confidential settlement and licensing agreement was obtained for the Plaintiff.

PERSONAL INJURY JURY VERDICT

Cause No. 2000-12486; Fogarty v. Nandlal, et al.,In the 280th District Court of Harris County, Texas. Plaintiff’s vehicle was struck from behind by multiple vehicles while he was stopped on U.S. 59 in Houston, Texas. Plaintiff filed suit against three drivers for negligently causing the collision and his injuries. Plaintiff claimed $1,700 in property damage to his vehicle. Plaintiff attended physical therapy for several months. After two days of deliberations, Mr. Kinsel, co-counsel, obtained a jury verdict for the Plaintiff.

PERSONAL INJURY SETTLEMENT

Cause No. 2005-44699; Stagg v. Glenn; In the 80th Judicial District Court of Harris County, Texas. Mr. Kinsel represented the Plaintiff, the front-seat passenger in Defendant's vehicle. Defendant was street racing on a city street when he lost control of his vehicle and crashed into a tree. The back-seat passenger died at the scene of the accident. Plaintiff suffered serious physical and emotional injuries as a result of this terrible incident. On the eve of trial, the parties agreed to a confidential settlement.

BUSINESS LITIGATION SETTLEMENT

Cause GN-402522; Pamela Lucak v. Roger Beasley, et al; In the 345th Judicial District Court of Travis County. Mr. Kinsel represented Mr. Beasley in this suit on a promissory note. The parties agreed to a confidential settlement.

PATENT INFRINGEMENT - SETTLEMENT & LICENSING AGREEMENT

Cause No. 9:06-CV-25; E-Watch, Inc., a Nevada Corporation and E-Watch Corporation, a Texas Corporation v. March Networks Corporation; In the United States District Court for the Eastern District of Texas; Lufkin Division. Moore Landrey LLP represented the Plaintiff / Inventor in this patent infringement case involving security devices. Confidential settlement and licensing agreement was obtained for the Plaintiff.

SEXUAL ASSAULT / HARASSMENT JUDGMENT

Cause 1:05CV217 & 1:05CV192; John Doe v. James Pelloat and the Newton County Independent School DistricT; In the United States District Court for the Eastern District of Texas. Mr. Kinsel represented the victims in this sexual assault case against James Pelloat, a teacher for the Newton Independent School District. Judgments were obtained against Mr. Pelloat for the Plaintiffs in March and June of 2006.

PERSONAL INJURY SETTLEMENT

Cause No. A 0172484; Haltom v. Gulf State Boats LLC; In the 58th Judicial District Court of Jefferson County, Texas. Mr. Kinsel, co-counsel, represented the Plaintiff in this Jones Act Seaman personal injury case. The parties agreed to a confidential settlement during the trial.

PERSONAL INJURY SETTLEMENT

Cause No. B 172-378; Barragan v. Entergy Gulf States Inc.; In the 60th District Court of Jefferson County, Texas. Mr. Kinsel represented the Plaintiff in this premises liability case. Plaintiff suffered severe injuries after being crushed by a butterfly valve and falling from scaffolding inside of a water pipe. The parties agreed to a confidential settlement.

MEDICAL MALPRACTICE SETTLEMENT

Cause No. E-0176733; Tara Winn & Teresa Martin Ind. and on Behalf of the Estate of Mary Marlene Forman, Deceased v. Harvey Randolph, M.D.; In the 172nd District Court of Jefferson County, Texas. Mr. Kinsel represented the Plaintiffs in this wrongful death medical malpractice case. The parties agreed to a confidential settlement.

CAFA Order Affirmed by the Ninth Circuit

Mr. Kinsel, co-counsel, successfully briefed and argued to the United States Ninth Circuit Court of Appeals in Abrego v. The Dow Chemical Corporation that a federal district court in California did not have jurisdiction pursuant to the Class Action Fairness Act based on diversity of citizenship and, as a result, an order remanding over 1000 Panamanian banana plantation workers’ cases to state court was affirmed. The Abrego decision is the first by a United States Circuit Court that interprets CAFA’s burden of proof, the amount in controversy requirement and the discretion district courts are given to authorize jurisdictional discovery.
