Lawyer Overview

Anita represents clients in the protection, exploitation, and enforcement of intellectual property rights, with particular focus on:

• IP enforcement and litigation in copyright, trademark, patent, design, and passing off — dealing with Anton Piller orders, injunction orders (ex parte and inter parte), and Norwich Pharmacal orders; formulating cross-border enforcement campaigns; and liaising with Customs and other governmental agencies regarding seizures and criminal prosecutions

• commercial IP work — advising on and drafting agreements in relation to licensing and assignments of IP rights (including software license and development), franchising, manufacturing and distribution, product advertising and sponsorship, entertainment, and media (artists, production houses, music publishers, and content providers); providing transactional support to mergers and acquisitions; conducting due diligence on acquisitions of IP rights, copyright materials, and film libraries; and providing general IP audits on clients' assets

• product regulatory work — advising on product regulatory and compliance issues (including food, cosmetics, health care products, nutritional supplements, and pharmaceutical products) such as product classification, registration, importation, labeling, advertising, and distribution and

• lobbying — since 1997, Anita has played an active role in lobbying the Hong Kong government on various legislation and policies, including the Copyright (Amendment) Ordinance, the copyright digital agenda, the Unsolicited Electronic Messages Ordinance, and the company name registration provisions of the Companies Ordinance.

Anita represents clients from a broad range of industries and works closely with governmental agencies. She sits on a number of committees, including the Law Society Intellectual Property Committee, the Copyright Committee of the Asian Patent Attorneys Association Hong Kong Chapter, and the Working Committees of the Intellectual Property Rights Protection Alliance and the Hong Kong Brand Protection Alliance. She is on the board of governors of the American Chamber of Commerce, a member of the Design, Marketing and Licensing Services Advisory Committee of the Hong Kong Trade Development Council, and a council member of the Federation of Women Lawyers. Anita is also vice chair of the Licensing Executive Society China, Hong Kong Sub-Chapter, vice chair of the Dispute Resolution Committee of the Licensing Executive Society International, and a member of the Companies Registry and IP Practitioners Liaison Committee, and The Hong Kong Institute of Trade Mark Practitioners. She is currently a nonpracticing member of the bars of England & Wales, the Australian Capital Territory, and Singapore.
