Lawyer Overview

Jason Starling concentrates his practice on management-side labor and employment law.

Since joining the firm, Mr. Starling has assisted in advocating for employers in both state and federal court on matters ranging from lawsuits by current or former employees alleging employment discrimination, to obtaining injunctive relief, damages, and attorneys' fees from former employees who misappropriate a company's trade secrets and/or violate non-competition agreements. Other litigation matters have included representing an employer before the Ohio Unemployment Compensation Commission, workers' compensation matters, and breach of contract actions.

Mr. Starling also has experience in traditional labor law, where he has assisted in labor arbitrations resolving the discipline or discharge of a union employee under a labor contract, as well as arbitrations regarding labor contract interpretation. His other traditional labor experience includes assisting with issues under the jurisdiction of the National Labor Relations Board or Ohio's State Employment Relations Board.

Beyond litigation matters, Mr. Starling has experience in effective counseling to help employers prevent litigation and its undesirable costs. He has assisted in counseling employers on issues arising under:

  • The federal Fair Labor Standards Act and Ohio's comparable wage and hour statute;
  • The Family and Medical Leave Act;
  • The Americans with Disabilities Act;
  • The Rehabilitation Act;
  • Title IX of the Education Amendments of 1972;
  • The Family Educational Rights and Privacy Act;
  • Federal and state drug-testing laws and regulations;
  • Federal and state laws on identity theft;
  • A reduction-in-force or mass layoffs;
  • Separation or severance agreements;
  • Employment contracts;
  • Non-compete, non-solicitation, non-disclosure, and/or trade secrets agreements;
  • Employee handbooks;
  • Workplace policies such as anti-harassment policies;
  • Affirmative action policies for employers who receive or apply for federal funding; and
  • The special constitutional limits which apply to a public employer's workplace.

Mr. Starling is a member of the American, Ohio State and Columbus Bar Associations.
