Lee Winkelman's labor and employment practice focuses on noncompetition, trade secret, and confidentiality issues related to current and departing employees and also includes litigation and counseling related to a wide variety of other workplace-related issues. He has litigated cases nationwide pending in state and federal courts, before arbitration panels, and before federal and state agencies involving illegal employment discrimination — under state and federal law; violations of the Family Medical Leave Act (FMLA); the Fair Labor Standards Act (wage and hour) (FLSA); the Employee Retirement Income Security Act (ERISA); Sarbanes-Oxley whistleblower claims; breach of contract claims; and employment-related torts. In addition, Lee has counseled employers regarding FMLA, drug testing, and antidiscrimination policies and employer obligations under FLSA, the Fair Credit Reporting Act (FCRA), and other workplace-related state and federal laws and regulations.
