Lawyer Overview

Chris's practice focuses on commercial litigation and arbitration, including complex contract disputes, constitutional law, and civil antitrust matters. He has represented a wide range of clients — including pharmaceutical companies, retailers, and engineering and construction firms — at the trial and appellate levels.

Chris has significant experience assisting clients in civil antitrust matters related to the enforcement of pharmaceutical patents, including prelitigation counseling and defense against Walker Process and sham litigation allegations arising from patent enforcement litigation. Most recently, Chris participated in the successful defense of Aventis Pharmaceuticals against Walker Process allegations brought by direct and indirect purchasers of desmopressin acetate tablets after the patent covering the tablets had been held unenforceable in a prior patent enforcement action. The district court granted Aventis's motion to dismiss the direct and indirect purchasers' antitrust claims against the patent holder and Aventis (the patent's exclusive U.S. licensee), holding, inter alia, that (i) purchaser plaintiffs did not have standing to bring Walker Process-type claims and that (ii) the plaintiffs had not — indeed could not — demonstrate the requisite fraud necessary to state a Walker Process claim against either defendant. See In re DDAVP Direct and Indirect Purchaser Antitrust Litigation, Civil Action No. 05-2237 (S.D.N.Y. Nov. 2, 2006) (Brieant, J.).
