General Commercial Litigation: Messrs. DKR's partners have litigated in state and federal courts, bankruptcy courts, private arbitration forums, and state and federal appellate courts.
Securities Arbitration and Litigation: The Firm's partners have extensive experience in the securities arbitration and litigation arena, both in the representation of individual and institutional investors against brokerage firms and also in the representation of brokerage firms accused of misconduct. Mr. Dimond spent the first five-and-one-half years of his career with Morgan Lewis & Bockius, LLP, one of the nation's largest law firms, defending securities arbitration claims on behalf of large brokerage firms such as Merrill Lynch, Pierce, Fenner & Smith, Inc., Bear, Stearns & Co. Inc., and Oppenheimer & Co. Since 1999, however, Mr. Dimond has limited his securities practice to the representation of investors bringing claims for broker misconduct. Since 1997, Mr. Kaplan similarly has limited his securities practice exclusively to representing investors bringing claims for broker misconduct. Mr. Kaplan also has internal brokerage- firm experience, having worked for Shearson Lehman Brothers, Inc., where he developed asset allocation models and investment proposals for high-net-worth individuals. Mr. Dimond, Mr. Kaplan, and DKR's other lawyers collectively have assisted in the recovery of in excess of $20,000,000 on behalf of individual and corporate investors.
Class-Action Litigation: DKR also possesses broad-ranging and in-depth class-action experience, both in the defense and prosecution of such claims. Mr. Rothstein has participated in a variety of class actions, including a RICO-based class action involving the recovery of in excess of $6 million on behalf of a class of investors who fell victim to a Ponzi scheme. Mr. Dimond defended numerous class actions during his years with Morgan, Lewis & Bockius LLP, and has been involved in the successful prosecution of several class-action claims as a partner with Hanzman & Criden, P.A. Such successful claims include the recovery of approximately $50,000,000 in value on behalf of customers of Sears, Roebuck and Co. as a result of alleged improprieties in the sale of credit insurance by Sears and Allstate Insurance Company. Collectively, Messrs. Dimond and Rothstein have participated in a broad range of national class actions involving securities, insurance, monopolistic and anti-competitive conduct, RICO, the Truth-in-Lending Act, and other consumer-protection statutes.
DKR Fees and Creative-Fee Arrangements: In certain cases the Firm has arranged creative fee structures in order to best serve varying clients' needs. Indeed, while many of DKR's cases are handled on a purely billable-fee basis or purely contingency-fee basis, the Firm has structured a number of hybrid fee arrangements whereby clients pay a reduced hourly rate coupled with a reduced contingency fee upon the successful resolution of a case. The Firm believes that such arrangements often can provide a client with the maximum combination of value and contingency incentivization.
