Lawyer Overview

A partner in the Litigation Department, James Brochin focuses his practice on white collar criminal defense and government regulatory matters. He represents both individuals and corporations in a wide variety of government investigations, including several high-profile investigations by the Department of Justice, the New York Attorney General’s Office, and the Securities and Exchange Commission. Mr. Brochin’s practice also includes a variety of complex civil matters in areas ranging from securities fraud to product liability to actions under the Racketeer Influenced and Corrupt Organizations Act (RICO). Recent significant matters include: Representation of the former Chief of Staff to the Vice President in his highly publicized trial and subsequent proceedings. Representation of the General Counsel of a telecommunications company in Justice Department and SEC investigations into stock options backdating. Representation of a major pharmaceutical corporation in a Justice Department investigation into alleged off-label marketing. Representation of U.S. Senator Robert Torricelli in the Department of Justice’s campaign finance investigation. Representation of a major pharmaceutical corporation in securities class action and related shareholder derivative suit alleging accounting improprieties. Representation of a major tobacco company in defense of one of the largest civil RICO cases ever brought. Mr. Brochin clerked for the Honorable Kimba M. Wood of the United States District Court for the Southern District of New York. He is a member of the Committee on Criminal Law of the Association of the Bar of the City of New York and the National Association of Criminal Defense Lawyers. He served as a notes editor of the Yale Law Journal.
