Brian Boynton is a partner in the firm's Litigation/Controversy Department, and a member of the Appellate and Supreme Court Litigation Practice Group, the Business Trial Group, and the Government and Regulatory Litigation Practice Group. He joined the firm in 2002. Mr. Boynton has a general litigation practice with an emphasis on constitutional litigation.

Practice

Mr. Boynton's practice focuses on trial and appellate civil litigation. He has represented clients at all stages of trial litigation, as well as on appeal from various adverse decisions. Mr. Boynton also has experience litigating and counseling clients with respect to questions of constitutional law.

Recent Highlights

Mr. Boynton's recent experience includes:

• Defending agricultural commodity research and promotion programs against First Amendment and other constitutional challenges, including the successful defense of the Cotton Research and Promotion Act
• Representing the former owner of a major newspaper in a long-running dispute over ownership of the paper; assisted in two successful appeals to the Tenth Circuit in that case and is now part of the team litigating the case on remand to district court
• Representing a major telecommunications carrier in a multidistrict class action litigation raising important issues of federal statutory and constitutional law
• Representing a trade association in connection with a constitutional challenge to legislation imposing price controls on certain patented products
• Representing a national retailer in an appeal to the Court of Appeals for the Eighth Circuit seeking to set aside a $4.5 million compensatory and over $33 million punitive damage award entered against the company
• Representing a motion picture studio in an administrative law challenge before the Court of Appeals for the District of Columbia Circuit seeking to set aside a US Copyright Office decision regarding the distribution of cable and satellite royalty payments
