Kate Hertel's practice focuses on complex business litigation and white-collar criminal defense. Kate's experience includes litigating and counseling on matters in a wide range of areas, including intellectual property and technology-related matters (patent, copyright, trademark, trade secret, false advertising, and unfair competition), entertainment, bankruptcy, corporate internal investigations, RICO, and the full spectrum of fraud cases. She is also a certified deputy city attorney and has first-chaired several criminal trials.
Kate represents Fortune 500 corporations, public and private companies, law firms, and high-profile individuals. Among other representations, clients in public matters include Gateway (computer monitors), St. Vincent's Medical Center (organ transplants), Research In Motion (Blackberry handhelds), Hughes Electronic Corp. (DirecTV), Mag Instrument (flashlights), and Dole Food Company (worldwide use of DBCP pesticide). Some of Kate's notable cases include:
representation of a major Los Angeles law firm in connection with the criminal investigation and civil litigation arising out of Hollywood private eye Anthony Pellicano's wiretapping scandal
obtained dismissal with prejudice in federal court in a multimillion dollar contract dispute involving the sale of medical devices
representation of a well-known Hollywood producer in connection with the criminal investigation and related bankruptcy litigation arising out of allegations of fraudulently inflated film budgets
obtained a $9.5 million settlement on behalf of a foreign client in a breach of fiduciary duty action against a professional trustee corporation and
participated in obtaining a favorable settlement in a patent and civil RICO lawsuit involving "initiators" for automotive air bags after forensic tests proved that an inventor falsified lab notebooks and other evidence.
Kate also coauthored two articles: "Proliferation of the FCPA: Efforts to Level the Playing Field in International Business Transactions," published by the American Bar Association Criminal Justice Section and the Center for Legal Education White Collar Crime 2007, and "Markman Practice, Procedure, and Tactics," published in Patent Litigation 2000 by the Practising Law Institute.
