Dr. Holger Neumann specializes in regulatory law matters and German administrative and public law. For a number of years his practice has focused on the regulation of certain industries, namely telecommunications, media, and airlines, as well as on matters of German administrative law, with a special focus on environmental law.

Prior to joining Jones Day in 2003 Holger was head of the national telecommunications group and the head of the worldwide aviation group of another international law firm. He has been nominated as one of the world's leading lawyers in TMT/telecommunications by Chambers Global from 2002 to 2006 and as one of the leading names in telecommunications in Germany in the JUVE Handbook of German Commercial Law Firms for eight consecutive years.

Holger has been involved in the following major transactions, regulatory proceedings, and public and private litigation matters in telecommunications, aviation, media, and environmental law:

• Telecommunications: he has represented new entrants into the German market from the time such markets were first liberalized in 1998. He was involved in licensing and frequency allocation procedures (including the auction of the German 3G-licenses) in a number of interconnection proceedings, rate regulation cases, and cases concerning the abuse of dominant market position before the German telecommunications regulator (BNetzA). He has also handled a large number of telecommunications law matters before the civil, administrative, and appellate administrative courts in Germany. Holger regularly advises clients in the fixed and mobile telephony business as well as satellite operators on all telecommunication law issues, such as joint ventures, outsourcing, and cooperation projects; interconnection and co-location agreements; data protection issues; market definition, market analyses, and remedies proceedings under the new European regulatory framework; and regulatory proceedings concerning prize control or the abuse of a dominant market position, under both the jurisdiction of the telecommunications regulator and the competition authority (BKartA).

• Aviation: he has represented airlines in commercial as well as administrative and aviation law matters. He also represented several ground handling operators on issues concerning the liberalization of the European ground handling markets as well as on general competition law issues. His experience in aviation law includes the successful representation of a major German airline in litigation over airport charges before German courts and the European Court of Justice.

• Media: he has represented German television operators in regulatory and court proceedings concerning licensing, media supervision, and distribution of TV programs in the broadband cable networks. He was involved in administrative proceedings and subsequent administrative litigation concerning orders by the German State Media Supervision Authorities.

• Environmental: Holger published a basic comparative law study on U.S. and German environmental law in 1996 and has since advised German, U.S., and other international clients on issues of environmental law, predominantly in the context of M&A transactions. He has specifically focused on the responsibilities for soil and groundwater contamination in connection with mergers, consolidations, and the acquisition or divestiture of company assets. This included advice on the structuring of the transaction as well as negotiating and drafting the environmental clauses or agreements. In addition, Holger advised national and international clients in dealing with environmental agencies on cleanup orders or other environmental compliance issues. This also involved litigation before German administrative courts on environmental matters. His most recent experience includes compliance strategies with respect to national and European laws on hazardous substances and asbestos regulation as well as compliance with the European WEEE and RoHS Directives.

Prior to joining Jones Day, Holger practiced law for five years at Bruckhaus Westrick Stegemann (Freshfields) and was a partner for three years with Coudert Brothers. He has published and given presentations on various telecommunications, aviation, and environmental law topics.
