James Barabas is a counsel in the firm's Litigation/Controversy Department, and a member of the Intellectual Property Litigation Practice Group. He joined the firm in 2007.

Practice

Mr. Barabas' practice focuses on intellectual property litigation, with an emphasis on patent disputes. In particular, he has significant experience representing clients in patent litigation in the chemical, pharmaceutical and biotechnology industries. In the chemical and biotech areas, he is involved in litigations concerning DNA microarrays, labeling reagents, immunochemical detection systems, and intermediates used in the manufacture of nylon. In the pharmaceutical area, he has been involved in several Hatch-Waxman litigations. Mr. Barabas also has experience litigating patent cases in the mechanical and electrical areas, and has represented clients in cases involving products ranging from spill-proof cups to liquid crystal displays.

Prior to joining WilmerHale, Mr. Barabas was an associate at Latham & Watkins.

Representative Patent Litigation Experience at Prior Firm

• Representation of defendants in declaratory judgment actions seeking determinations of non-infringement and invalidity of patents asserted against microarrays, labeling reagents, and immunochemical detection systems
• Representation of defendant in action alleging patent infringement by defendant's spill-proof cups, resulting in a summary judgment of non-infringement

Professional Activities

Mr. Barabas is a member of the American Bar Association, the American Intellectual Property Law Association and the New York Intellectual Property Law Association, where he serves on the Litigation Practice and Procedure Committee.
