Lawyer Overview
Dan represents clients in civil cases at the trial and appellate levels. He has litigated cases in numerous state and federal courts involving many different substantive areas of law, including accounting malpractice, bankruptcy, consumer sales, elections, energy, franchise, intellectual property, mortgage foreclosure, and tax. He also has extensive experience with multimillion dollar breach of contract litigation and, in particular, complex damages issues. Representative clients include American Electric Power, Battelle Memorial Institute, BP, Dell, Lehman Brothers, and the Major League Baseball Players' Association.
Dan has helped Jones Day achieve a number of significant victories for its clients, including a $263 million settlement for AEP in a New York case involving the breach of a long-term power supply contract. Dan took an active role in developing AEP's successful argument to the Second Circuit Court of Appeals that the trial court's original damages award of $123 million failed to adequately compensate AEP for its losses. On remand for a re-determination of AEP's damages, the case was settled for more than double the trial court's original award. The novel damages issues the case presented, and the Firm's creative arguments on behalf of AEP, were later written about in the Columbia Law Review and the New York Law Journal.
In another case, acting as local defense counsel, Dan helped a Chicago client secure an unexpectedly quick victory by working to develop an alternative strategy for the litigation that included moving for a complete dismissal. After receiving the motion to dismiss, the plaintiff conceded and stipulated to a dismissal with prejudice, promptly ending what could have been a lengthy and expensive matter for the client.
Dan also has taken active roles in the community, handling pro bono matters, writing legal articles, serving on the Tourette Syndrome Association of Ohio's board of directors, and participating in the Columbus Bar Association's Barrister Leader Program. His efforts have been recognized by both the Columbus Bar Foundation and Association, which presented him with their award for "Outstanding Pro Bono Service by an Individual."
Prior to joining the Columbus Office, Dan worked in the Firm's Los Angeles Office.
