David DiMeglio practices in the area of general civil litigation, with an emphasis in toxic torts and product liability. David's product liability experience encompasses products ranging from consumer electronics, personal protective equipment, and automated garage doors to pressurized gas cylinders and heavy equipment used in the trucking industry. His toxic tort experience includes defending against claims of cancer, a variety of other chronic diseases, asbestosis, silicosis, and infertility.

His recent trial experience includes his role as a member of the trial team in In re San Jose IBM Workers Litigation, a high-profile case involving complex issues of chemical exposure and alleged health effects. After nearly five months of trial in California state court, the jury returned a unanimous defense verdict as to both plaintiffs whose claims were tried. In the same litigation, he obtained summary judgment on the claims of two other plaintiffs on the eve of trial. The defense victory for IBM in this litigation — the first case of its type to go to trial against the microelectronics industry — was recognized as one of the top defense verdicts of 2004.

David has worked extensively with a wide range of experts in toxic tort and product liability litigation, at the pretrial and trial phases, including experts in the fields of cancer and reproductive epidemiology, toxicology, exposure assessment, occupational medicine, urology and reproductive medicine, obstetrics and gynecology, immunology, psychology, industrial hygiene, and engineering.

David also has had substantial experience in other complex civil cases, in state and federal courts, including claims of employment discrimination and wrongful termination, breach of contract, fraud, antitrust violations, unfair business practices, violations of California's Proposition 65, and private cost recovery and contribution arising under CERCLA, RCRA, and various state environmental laws. David is admitted to practice in California, the courts of all four federal districts in the state, and the Ninth Circuit Court of Appeals. He is also fluent in Spanish.
