Lawyer Overview
Joseph A. Sacher is a Director with the Firm whose active practice areas include corporate, banking and securities transactions, compliance, regulatory matters and litigation, as well as general commercial litigation in state and federal courts.
Mr. Sacher has worked as an intern for the SEC in the former Atlanta Regional (now, Branch) Office, and has been published in the area of the Federal securities laws, particularly the Sarbanes-Oxley Act of 2002.
See B. Sacher, S. Burr, and J. Sacher, "The Public Company Accounting Reform and Protection Act: The changing landscape of public corporations and the accounting and law firms who provide them services," The Florida Bar News (Sept. 1, 2002).
Mr. Sacher has also lectured to CPAs and Atorneys on issues relating to accountant's liability.
In the litigation arena, Mr. Sacher represents individuals and entities in general and complex, multi-million dollar civil litigation as both plaintiffs and defendants. Mr. Sacher has particular litigation experience in the Securities and Exchange Commission ("SEC") enforcement arena, having advised and defended various individuals, entities, local and regional and public companies, as simple subpoena recipients, targets in the early stages of enforcement investigations, and as named defendants in full-blown enforcement actions brought by the SEC.
Separate from his experience in general and specialized litigation matters, Mr. Sacher also acts as general outside corporate and securities counsel to various types of business entities, including public companies and banks. In such a capacity, Mr. Sacher provides general advice, drafts corporate documents, assists in financing, maintenance, regulatory compliance, and acts as a liaison to State and Federal regulatory authorities, with particular emphasis on crisis management.
Mr. Sacher also represents banking entities, providing numerous and extensive functions in the areas of litigation and corporate representation, including, but not limited to legal services in the areas of shareholder derivative actions, regulatory compliance, divestiture proceedings, proxy voting, and subpoena compliance.
He earned his B.A. in Liberal Studies at Emory University in 1994, and received his J.D. degree from the University of Alabama School of Law in 1997. He received his first bar membership in 1997 from Georgia, and subsequently became a member of The Florida Bar in 1999. After a year of private practice in Atlanta, Georgia, as a white collar criminal defense attorney, Mr. Sacher relocated to Miami, Florida, and joined the Firm in 1998. Mr. Sacher has both varied and extensive experience with the Firm in several areas.
