Lawyer Overview
Nick Cotter has broad experience in complex commercial and regulatory litigation in a number of courts. He has handled litigation in the Queen's Bench and Chancery Divisions of the English High Court (including in the specialist Administrative, the Commercial, and the Technology and Construction Courts), together with appeals to the Court of Appeal, House of Lords, and the Privy Council. He also has represented clients in various high courts and appeal courts in the Caribbean.
The claims in these courts have concerned, most notably, the taxation of power stations in the U.K., the enforceability of exclusive European distribution agreements, problems arising in major IT projects, and Russian banking issues. Recently, he has been acting for Digicel in several cases against Cable & Wireless plc regarding telecommunications interconnection rates (in Trinidad & Tobago and in the Cayman Islands) and in a major English High Court claim concerning anticompetitive practices in the Caribbean.
In addition, Nick has represented clients in international arbitrations, both ad hoc and under institutional rules (including the ICC, UNCITRAL, LMAA, GAFTA, and FOSFA). These arbitrations have involved shipping and international sale of goods claims, Russian banking issues, clean up costs for contaminated land, insurance coverage issues, and, most recently, complex telecommunications issues.
