Chapter 7

A Chapter 7 bankruptcy allows individuals to wipe out most debts. While certain debts may not be discharged, such as support arrearages, student loans and some taxes, Chapter 7 allows people to get fresh start. I will work hard to determine your eligibility for Chapter 7, exploring ways you might qualify under the means test even if your income is greater than the state median.

Chapter 13

Federal bankruptcy laws changed in 2005, making it more difficult for some individuals to qualify for protection under Chapter 7. However, even if you exceed income and asset requirements for Chapter 7, you have a good option with Chapter 13 bankruptcy. In a Chapter 13 filing, you debts are restructured so you can repay your creditors over a 3 to 5 year period, and your debts will discharged at the end of the repayment period.
