Lawyer Overview

Amy Pohl has broad experience in commercial litigation matters, including insurance coverage, product liability, consumer fraud, class actions, construction, and commercial disputes. She has appeared in state and federal courts handling all levels of general litigation practice, including deposition, discovery, motion, and alternative dispute resolution. Amy also has experience briefing and arguing before Pennsylvania's appellate courts.

Amy has successfully defended safety equipment manufacturers in numerous silica exposure product liability tort actions in Pennsylvania and New Jersey, including a 100-plaintiff mass tort program in Philadelphia, Pennsylvania. She has secured dismissals of the manufacturers in virtually every case. Amy also has been involved with discovery and depositions of plaintiffs' experts in product liability and negligence actions in West Virginia and Pennsylvania and has defended corporate clients in personal injury actions.

In addition, Amy has represented construction clients in bid disputes relating to state agency contracts and procurements. In 2003, Amy was a member of a litigation team in a case of first impression to the Commonwealth Court of Pennsylvania in which the court ultimately upheld competitive bidding requirements on government-funded construction projects. Amy successfully argued a key motion to a three-judge panel of the Commonwealth Court and obtained a favorable order from the court at the outset of the litigation. See Balsbaugh v. Commonwealth Department of General Services, 815 A.2d 36 (Commw. Ct. 2003).

In the area of consumer fraud and class actions, Amy worked on a litigation team that obtained a dismissal of a dealer reserve class action against auto dealerships in New Jersey. She also has experience with class action settlements and defense in class certification proceedings.

Amy has counseled clients on insurance policy interpretation and has litigated insurance coverage disputes. She was a member of a litigation team representing a plaintiff-company in a bad faith insurance coverage dispute against a national insurer, which resulted in a very favorable settlement for the client. She has represented corporate clients in actions seeking recovery under commercial insurance policies for costs incurred to investigate and remediate property damage. Amy has broad experience in general commercial and contract disputes as well. She has successfully represented commercial clients in all phases of litigation, in mediations/arbitrations, and appellate matters.

Amy is a member of the Pennsylvania Bar Association and the Allegheny County Bar Association. She is author of "Punitive Damages in Contract Actions: The Tension Between The United Nations Convention On Contracts For The International Sale of Goods And U.S. Law," 16 Journal of Law and Commerce 215 (Spring 1997) and coauthor with Jones Day Partner John Goetz of "Pennsylvania Interprets Its Blood Shield Statute To Protect Commercial Suppliers Of Blood Therapies," Mealey's Emerging Drugs & Devices, Vol. 5, Issue 10 (May 25, 2000).
