For more than 20 years, Jim Cox has successfully resolved his clients most challenging and difficult litigation matters, particularly class actions, cases in "tough" jurisdictions, and complex technology-related disputes. Jim's approach is strategic. He does not simply "manage" or "handle" cases; he develops strategies to win them. Most cases settle, but the best way to achieve a good settlement is to have a strategy to win.
Jim has successfully defended clients in dozens of class action cases in state and federal courts around the country. His cases have involved claims based on RICO, conspiracy, antitrust, consumer fraud, breach of contract, and other theories. Recently, along with a Jones Day team, Jim represented a large computer services company in a complex commercial dispute in arbitration in which both parties asserted multimillion dollar claims relating to the closing of a joint venture transaction. After a three-week trial in New York, the panel awarded $57.5 million to Jones Day's client and nothing to the other side. Jim and a team were also called in to take over the defense of a nationwide class action on behalf of another major computer services provider facing hundreds of millions of dollars in potential claims. Because of Jones Day's work, the case settled favorably just before the class certification hearing.
Jim is frequently asked to speak on topics relating to complex litigation, including electronic discovery.
