James Nesci is a graduate of the University of Arizona College of Law and has been a solo practitioner since January 1st, 1995 in Tucson, Arizona. He graduated cum laude from the University of Arizona with a B.A. in 1991 and graduated from Law School in 1994. He is an honorably discharged veteran of the U.S. Navy.
In 1999 Mr. Nesci became a Sustaining Member of the National College for DUI Defense.
In 2001, Mr. Nesci passed all tests and requirements for Board Certification from the National College for DUI Defense. In the Summer of 2001 he was officially Board Certified and is one of only two Board Certified attorneys in the State of Arizona.
His practice is devoted entirely to criminal defense. At any one time, he typically defends about thirty DUI cases in several jurisdictions. Mr. Nesci often defends cases well into the .30 blood-alcohol range. Mr. Nesci has caught more than one police officer lying during cross-examination and some police officers have even refused to grant pretrial interviews to him without a prosecutor or their own counsel present. He was one of the lead attorneys on the RBT-IV breath-testing issue in Southern Arizona which resulted in the suppression of breath tests in over 3,000 cases and the removal of the RBT-IV from the streets of Arizona.
Mr. Nesci is a team-player within the Southern Arizona DUI Defense Community. He is often involved in large-scale challenges to DUI investigative methods and chemical testing. His opinion is sought by DUI Attorneys across the nation on various issues.
Not only has Mr. Nesci attended dozens of criminal seminars, he has been a speaker at several statewide and national DUI seminars including the New York State Bar Association, The California Attorneys for Criminal Justice, The Nevada State Bar Association, The Arizona Attorneys for Criminal Justice, The National College for DUI Defense, The Maricopa County Bar Association, and the National Association of Criminal Defense Lawyers. He has taught seminars on the subjects of cross-examination, trial tactics, field sobriety testing, blood alcohol calculations, and breath testing. He is a frequent guest of the John C. Scott radio program on KTKT 990 A.M. in Tucson. The Tucson Weekly has named Mr. Nesci "King of the DUI Defense" in its December 19, 2002 issue.
He is a member of the Arizona Attorney's for Criminal Justice where he has served on the DUI Committee since 1998. He is also a member of the American Bar Association, the National Association of Criminal Defense Lawyers, and the National College for DUI Defense. He is admitted to practice in all courts in Arizona as well as the United States District Court for the District of Arizona, and the Ninth Circuit Court of Appeals.
In addition to his DUI practice, Mr. Nesci also defends many other types of criminal charges. Mr. Nesci frequently defends domestic violence cases, prostitution, drug possession, aggravated assault, shoplifting, theft and all vehicular crimes.
Born and raised in New York, Mr. Nesci moved to Arizona in the fall of 1984 after being discharged from the U.S. Navy. He worked as a real estate salesman and carpet installer prior to and while attending the University of Arizona. He graduated from the University of Arizona with a B.A. (cum laude), majoring in creative writing with a minor in speech communications. While attending law school he completed an eight-month long internship at the Pima County Attorney's office as a prosecutor. While still in law school, Mr. Nesci was the lead attorney on six jury trials and over fifty bench trials. Comparatively, most attorneys do not handle a jury trial as the lead attorney in their first two years of practice.
Mr. Nesci is married with two children. His interests are traveling, woodworking, and fast cars. He is an amateur race car driver, mechanic, and a Corvette fanatic.
