Law Firm Overview
Morck Family Law was founded in 1995 by two experienced professionals whose combined membership in the California State Bar exceeds 45 years. Our legal philosophy is focused upon helping our clients while minimizing conflict. It is always our goal is to keep legal fees reasonable while fulfilling our client's legal objectives expeditiously.
Morck Family Law litigates aggressively when necessary, but we never litigate unnecessarily. We never forget our client's have to continue to be parents after a divorce, and we will not use litigious tactics that unnecessarily increase costs, delay settlement or harm anyone emotionally, especially the children.
Morck Family Law uses the latest computer technology and legal and office productivity software to increase our efficiency. This allows us to operate without the need of the expensive support staff required by most law firms. These cost savings and benefits are passed on to our client's in the form of lower fees and more personal service.
Services
dissolution of marriage
If you have made the decision to end your marriage, we can advise you as to
what your rights are, what procedures you must follow, and how long it will take
for your dissolution to become final. We can also advise you regarding legal
separations and annulments.
consulting counsel
Wendy Morck is available to serve as a consulting counsel for mediated
dissolutions. As a consulting counsel, Wendy can provide legal analysis of
issues at hand, alternative and creative option for possible settlement
alternatives. As a consulting attorney, we review and comment on the final
documents which are drafted by the mediator.
collaborative law
This is another form of alternative dispute resolution. If both parties
agree, disputes can be reduced to enforceable judgments through negotiations
among the parties and their counsels. Most, if not all, of the litigation and
adversarial process can be avoided. This can save time, money and reduce the
emotional impact of the dissolution process. The collaborative law process is
committed to keeping the case out of the courtroom. Each party has his or her
own legal representative. Negotiations are conducted in 4-way meetings between
both parties and their counsel.
mediation
If both parties are willing to try, mediation can be a valuable alternative
method to settling many of the disputes that accompany a dissolution without
having to resort to the often unpleasant nature of litigation or adversarial
tactics. It can save time, money and emotional strain. As a Mediator, we do not
represent either party so we encourage each party to work with a consulting
attorney in order to be fully informed of all rights provided by the law.
support
Everyone is entitled to know whether he or she is receiving too little or
paying too much in either spousal or child support. Everyone needs to know also
what circumstances can cause support obligations to change. Morck Family Law
can advise you properly in this area, and help you achieve proper support
obligations or modify existing orders if your circumstances have changed.
support enforcement
An individual's support order is of little value, if the opposing party is
ignoring it. At Morck Family Law we can assist you in making sure your support
orders are properly enforced.
custody & visitation
This can be a very frustrating area when opposing parties are ignoring
and/or frustrating their obligations. At Morck Family Law we can assist
you in making sure your custody and visitation obligations are reasonable, and
that your rights are and will be upheld.. Our philosophy, like that of the State
of California, is to provide both parents with frequent and continuing contact
with their children, and reduce conflict between the parents in order to
facilitate healthy co-parenting arrangements. We strive to keep kids out of the
middle and encourage parents to make use of the kid programs available to them
such as "Kids in the Middle."
pre-nuptial and post-nuptial agreements
The need for these kinds of agreements are becoming increasingly important
as our economic circumstances become more complex. It is prudent that certain
kinds of property acquired before and after a marriage be identified and its
potential future disposition clearly agreed to in one of these agreements as
opposed to being forced to litigate it later if the marriage should dissolve.
private judging
Wendy Morck is available to serve as a private judge. Wendy has served as a
Judge Pro Tem in San Mateo County for over 10 years. She is experienced and very
successful in helping to craft settlements in cases and to narrow the unresolved
issues that need to go to a trial.
special master
Wendy Morck is available to serve as a special master in custody disputes,
discovery and document production, division of furniture and furnishings as well
as to mediate issues that need a third party to resolve.
unbundling
Many times parties do not need the services of an attorney on each and every
issue in the dissolution of their marriage or in the negotiations to modify an
existing order. We can offer legal advice, when requested to do so, on single
issues such as the division of a business, the modification of support, or the
drafting of a custody and visitation order. We can also assist in securing the
proper order necessary to divide retirement benefits.
post-judgment modifications
- support
- custody
- visitation
At Morck Family Law we can assist you in the modification of these kinds of
orders subsequent to your court ordered judgment.
