Lawyer Overview
Simon E. Dance is a partner with Foley & Lardner LLP, and a member of the firm's IP Litigation, General Commercial Litigation, Environmental Regulation and International Practices. Mr. Dance is an experienced litigator before federal and state courts and the U.S. International Trade Commission. He focuses his practice on counseling and representing clients for litigation, environmental, and transactional matters.
Mr. Dance has served as counsel and/or co-counsel for all aspects of complex litigation matters, including appellate and Supreme Court practice, IP Litigation, Section 337 unfair trade practices cases, and federal district court actions involving environmental litigation, contract claims, contribution and cost recovery actions, and the misappropriation of trade secrets.
He has advised businesses on regulatory compliance with local, state and federal laws governing a wide range of environmental matters. He also has represented clients in negotiating state voluntary cleanups, prospective purchaser agreements, de minimis settlements and consent orders, indemnification agreements underlying public offerings, mergers and acquisitions, project financing, and stock and asset purchases, Brownfield redevelopments, CERCLA contribution actions, and pollution coverage/insurance claims.
Mr. Dance authored the IP Law 360 guest column on the Federal Circuit's reversal of the ITC in Kyocera Wireless Corp. et al. v ITC et al., regarding the extent of the ITC's remedies to downstream products of entities that were not parties in the litigation. He also presented "Section 337 Investigations Before The International Trade Commission: The Other Rocket Docket," at the Patent Nation Seminar each of the last two years.
Mr. Dance graduated from the University of Notre Dame Law School, where he served as editor-in-chief for the Journal of Legislation. He combines his legal expertise with over 15 years of U.S. and international oil and gas industry experience. After graduating, with honors, from Imperial College of Science, Technology, and Medicine, University of London (B.Sc., petroleum engineering, 1976), Mr. Dance managed the evaluation, financing, and development of numerous U.S. and foreign onshore and offshore oil and gas projects for British Petroleum.
Mr. Dance is admitted to practice in the District of Columbia, in Pennsylvania, and the Courts of Appeal for the Federal Circuit and the District of Columbia. He is a member of the American Bar Association, the Environmental Law Institute, and the Executive Committee of the ITC Trial Lawyers' Association.
