Our attorneys concentrate their practice in the areas of public utility, administrative, water, environmental, and consumer law, as well as legislative representation. We are proud to have served a variety of client interests and industries for more than three decades, including cities and counties, grocery stores, retailers, hospitals, statewide associations, consumer groups, worker organizations, homeowners' associations, farmers and ranchers, colleges and schools, water utilities, river authorities, municipal utility districts, and small telecommunications companies.

The cases we handle typically address complex legal, financial, scientific, and public policy issues. In addition to strong advocacy by the firm's attorneys, our representation frequently involves the use of expert witnesses such as economists, accountants, engineers, and chemists. Because of the complexity of cases, our attorneys must be detail-oriented, intense and aggressive.

Practice Areas

PUBLIC UTILITY LAW

Our attorneys represent clients before the Public Utility Commission of Texas regarding electric and telephone rates and related matters, and before the Railroad Commission on gas utility regulatory matters. Representation involves a range of issues, including electric and telephone utility rate-making, regulatory and rulemaking proceedings, utility deregulation, franchise agreements with investor-owned utilities, mergers and acquisitions of utilities, location of transmission lines, extended local calling, labor-related issues, and appellate proceedings.


ENVIRONMENTAL LAW

Environmental matters are handled in a range of areas, including surface water and groundwater quality, air quality, hazardous waste management, composting facilities management, municipal solid waste disposal and recycling, location of gas and electric transmission facilities, effects of high voltage utility wires, superfund voluntary cleanup, underground and aboveground petroleum storage tank remediation. Clients may be represented before the Texas Natural Resource Conservation Commission, Public Utility Commission of Texas, Texas Railroad Commission, U.S. Environmental Protection Agency, U.S. Army Corps of Engineers, U.S. Bureau of Reclamation, and U.S. Fish and Wildlife Service.

ADMINISTRATIVE LAW

The firm represents a diverse clientele in matters before state agencies, including the Public Utility Commission, Texas Natural Resource Conservation Commission, Comptroller of Public Accounts, Texas Education Agency, Consumer Credit Commission, Texas Employment Commission, Texas Department of Insurance, Railroad Commission, Employees Retirement Systems, Sunset Commission, and others.

WATER LAW

We focus on all legal aspects of water and wastewater utility operations; project permitting; water, wastewater management and discharge, water and drainage utility pricing; and utility rate matters before various regulatory bodies, including the Texas Natural Resource Conservation Commission.

CONSUMER LAW

Business consumers and individual consumers are represented in complex deceptive trade practice and lender liability litigation, including class actions.

 

LEGISLATIVE REPRESENTATION

Some matters can only be addressed by advocacy at the Texas Legislature to write or change a law. Jim Boyle is a registered lobbyist, and he is at the State Capitol on a daily basis during legislative sessions. He meets with legislators and their assistants, drafts and amends bills, lobbies on behalf of clients and the public, testifies at committee hearings, and shares background information with news reporters. In addition, he monitors and reports to clients on statutory development. The law firm's office is located at 1005 Congress Avenue, directly across from the Capitol. When a client needs quick action, an attorney can be in a legislator's Capitol office within minutes. In some instances, the firm also advocates for clients before the U.S. Congress and federal agencies.
