James Dowd is a partner in the firm's Securities and Litigation/Controversy Departments, and a member of the Intellectual Property Litigation and Appellate and Supreme Court Litigation Practice Groups. Mr. Dowd joined the firm in 1997.

Practice

Mr. Dowd's practice focuses on patent litigation and strategy. He has represented a broad range of clients, including in jury and bench trials and appeals, in cases involving such diverse technologies as semiconductor manufacturing, integrated circuits, solid-state memories, telecommunications, medical devices, and biological products. He practices in courts nationwide, and has extensive experience before the US International Trade Commission.

Recent Highlights

  • Represented manufacturer of Global Positioning System chips and chipsets in successive trials before the International Trade Commission. In the first case, where client was accused of infringing more than 120 claims of four patents, achieved determination that no claim was infringed (and many anticipated). In client’s countersuit to enforce its own patents, the initial determination is pending and the Office of Unfair Import Investigations recommends a finding of violation.
  • Represented flash memory manufacturer accused of infringing three patents before the International Trade Commission in obtaining a finding that no valid claim was infringed
  • Represented telecommunications company prevailing on patent to air interface protocol technology
  • Represented publicly traded semiconductor manufacturer in obtaining determination that its accused chip did not infringe for multiple independent factual reasons
  • Obtained Markman ruling in two patent case involving arthoscopic instruments leading directly to favorable settlement
  • Represented publicly traded supplier of microlithography equipment in obtaining determination that patent asserted against supplier’s products was unenforceable and invalid
