Nenad Krek is a partner in the firm's Honolulu office and is a member of the Litigation & Alternative Dispute Resolution Practice Group.  He concentrates his practice on admiralty, maritime and insurance law. Mr. Krek is an accomplished litigator with substantial experience in federal and business litigation. His clients include a number of P&I Clubs, shipowners and marine underwriters located throughout the world, and a leading insurance broker. 

Representative Matters

Cargo Fire Defense of a cargo damage claim arising out of a fire on board a bulk carrier. Judgment for defense was affirmed on appeal.

Stranding Defense of a claim by a shipowner arising out of stranding of a tanker and the resulting oil spills. Judgment for defense was affirmed by the Supreme Court of the United States.

Sinking Obtained summary judgment in favor of a shipbuilder against a wrongful death claim arising out of a sudden sinking of a fishing vessel.

Collision Defense of a container ship from claims by the owners of a fishing vessel lost in the collision.

Oil Spills Assistance to shipowners in OPA 90 incidents, defense of claims arising from pollution or threatened pollution, including NRDA claims, and prosecution of third-party claims for indemnity and contribution.  

Cargo Claims Defense of various liquid cargo claims, ranging from ROB to jet fuel contamination, as well as bulk and general cargo claims, including claims involving refrigerated containers, and claims involving package limitation.

Pier Allision Defense of pier allision claims, including one litigated in the High Court of the Republic of Marshall Islands.

Vessel Theft Arrest and recovery of a stolen fishing vessel in Tonga.

Charterparties Litigation of charterparty disputes, including an arrest, on behalf of the shipowner, of bunkers owned by Cuban charterers.

Cruise Lines Defense of personal injury claims against various cruise lines. Obtained summary judgment against claims by some 200 seamen seeking damages for alleged exposure to asbestos on board a cruise vessel.

Foreclosure Foreclosure of ship mortgages, including mortgages on large cruise vessels, and litigation of validity, priority and amount of maritime liens.

Distinctions
Insurance Coverage Obtained summary judgment declaring that a day-cruise vessel's P&I policy did not cover liabilities arising from the death of a passenger snorkeling off the vessel. Judgment was affirmed on appeal.
Insurance Broker Long-term representation of a leading insurance broker in E&O matters and other litigation.
Lender Liability Defense of a bank against lender liability claims, leading to a directed verdict in favor of the bank.
Securities  Prosecution of damage claims by a bank for misrepresentation in the sale of securities, leading to a favorable settlement.
