Lawyer Overview
David Fleischer, a partner in the Litigation practice at Paul Hastings, represents clients in a wide range of commercial litigation matters, including consumer class actions, intellectual property and contract disputes, real estate and construction litigation, governmental investigations, bankruptcy and creditors rights, corporate governance and environmental matters and is experienced in resolving disputes through negotiation, mediation, arbitration and judicial proceedings. Mr. Fleischer is actively involved in representing Fidelity National Title Group, Inc. and its title insurance underwriter subsidiaries in consumer class actions and regulatory matters throughout the United States and in coverage and claims matters. Mr. Fleischer represented the interests of the successful Chapter 11 plan proponent in In re Marvel Entertainment Group, Inc. which involved several highly-contested corporate governance and intellectual property matters, including the feature film rights to Marvel’s Spider-Man and Blade characters. Mr. Fleischer has continued to represent Marvel Entertainment, Inc., in numerous contract and licensing disputes, including those involving rights to the Spider-Man, Captain America, Hulk and X-Men characters. Mr. Fleischer has also represented GE Capital in its capacity as a secured lender in a variety of bankruptcy cases. Mr. Fleischer has represented institutional clients such as Citicorp and JPMorgan Chase in a variety of real estate and construction disputes in arbitration and judicial proceedings. Mr. Fleischer was litigation counsel for Travelers in Travelers Ins. Co. v. 633 Third Assocs., in which Travelers sought to set aside and enjoin as fraudulent conveyances certain distributions to the equity partners of a non-recourse borrower. That litigation produced two opinions in the Second Circuit Court of Appeals holding that, notwithstanding broad exculpation language in its loan documents, Travelers had standing to pursue fraudulent conveyance causes of action against the borrower and its partners. Mr. Fleischer graduated in 1968 from The Wharton School of the University of Pennsylvania with a B.S. in Economics and received his J.D. from New York University School of Law in 1972.
