Lawyer Overview
Peter McAllen, who previously taught civil procedure, complex litigation, and conflicts of law, practices at the trial and appellate level in the area of business litigation and has experience in antitrust, banking and mortgages, partnership management and control litigation, securities, accountants' liability, environmental, insurance coverage, construction defect and payment disputes, bankruptcy, and other commercial litigation. He has been extensively involved in the prosecution and defense of large class actions and the defense of federal multidistrict litigation and has substantial first-chair trial experience in civil and criminal jury trials and in administrative bench trials.
Peter currently leads the defense of UPM-Kymmene in both the labelstock indirect purchaser price-fixing litigation and the publication paper indirect purchaser price-fixing litigation. He represents a municipal public utility district in complex multijurisdictional litigation arising from the California electric energy crisis of 2000-2001. He also led the team responsible for the defense of the "indirect purchaser" side of the Methionine price-fixing class action litigation for Aventis S.A. In addition, he represented the majority limited partner interest in the largest resort hotel in Hawaii in a dispute among partners over control, ownership shares, and buyout rights. Peter also headed the defense of Metropolitan Life Insurance Company in a class action and related opt-out actions alleging consumer fraud and "elder abuse" in the design, marketing, and servicing of a "reverse mortgage" financial product. Before joining Jones Day, Peter worked extensively for Alyeska Pipeline Service Company and its owners on litigation arising out of the Exxon Valdez oil spill.
Peter was an assistant professor of law and associate professor of law at Southern Illinois University from 1984 to 1989 and a visiting associate professor of law at Southwestern University from 1988 to 1989. He is a member of the American Judicature Society, the ABA (Litigation Section; Antitrust Law Section), the State Bar of California (Litigation Section; Antitrust and Unfair Competition Section), and the Los Angeles County Bar Association. He is coauthor of "The Moralist as Expert Witness," 61 B.U.L. Rev. 869-926 (1982) and the author of "Deference to the Plaintiff in Forum Non Conveniens," 12 S.I.U. L.J. 191-279 (1989).
