Mike Graham represents corporations and businesses in trials and appeals involving commercial and energy-related disputes in federal and state courts throughout the United States and in domestic and international arbitrations. Mike's major cases have included nationwide actions pursuant to the federal False Claims Act alleging the underpayment of federal and Indian oil and gas royalties; nationwide, multistate, statewide, and other class actions alleging underpayment of private oil and gas royalties; class and derivative actions following the restatement of financial statements by a NYSE company; international arbitrations involving corporate governance, joint venture management, and scope of noncompetition agreements; federal and state trials and domestic and international arbitrations concerning numerous energy-related disputes involving gas sales contracts, exploration agreements, operating agreements, and leases; federal and state litigation and international arbitrations concerning insurance coverages, including political risks and business interruption; defense of a major investment bank against allegations of misrepresentation and fraud; defense of a major law firm against allegations of professional misconduct; representation of a business software company against allegations of misappropriation of trade secrets; representation of a franchisee in litigation with a fast food franchisor; and numerous cases involving complex corporate transactions, including prosecuting or defending hostile acquisition attempts, mergers and acquisitions, corporate governance, and executive employment arrangements.
