Kevin Kennedy is a litigation partner at Wiggin and Dana who has represented the Subway franchisor, its affiliates, and other franchisors in numerous state and federal court lawsuits and arbitrations. He has argued and won appeals before the United States Court of Appeals for the Second Circuit, the Connecticut Appellate Court and the Connecticut Supreme Court, and has tried numerous franchise arbitrations to a conclusion. Mr. Kennedy was a former associate editor of the ABA’s Franchise Lawyer, and his article "The Use of Daubert and Its Progeny to Attack Lost-Profit Claims," for the ABA’s Franchise Law Journal, was selected for inclusion in the Best of ABA Sections magazine. His articles include, "Stolt-Nielsen SA: Prehearing Subpoenas on Third Parties Upheld by Arbitrators," published in ABA's Franchise Law Journal, Winter 2006; "$2.3 Million Verdict Affirmed for Insurance Agent Under Connecticut Franchise Act," published in the LJN Franchising Business & Law Alert, December 2005 and "Burger King v. Hinton: A Franchisor's Decision To Terminate The Franchise Agreement Defeats a Claim For Lost Future Royalties," published in The Franchise Lawyer Volume 6, Number 2, Fall 2002. Mr. Kennedy graduated from Connecticut College summa cum laude and a member of Phi Beta Kappa in 1988, and obtained his J.D. with honors from the University of Connecticut Law School in 1991.
