Alan Kindred is a partner with substantial international and intellectual property experience with high levels of success inside and outside the courtroom in the business affairs of multi national corporations. He possesses in-depth experience handling strategy and legal affairs involving trademarks, copyrights, licensing, anti-piracy, anti-counterfeiting, patents and trade secrets. Mr. Kindred has also developed and managed international IP portfolios for companies.
Mr. Kindred has successfully represented both large and mid-size corporate clients in dozens of cases in federal court. His representative clients have included General Electric, Westinghouse, Mercedes Benz, Rockwell International, Goodyear Tire & Rubber, Sumitomo Corporation and Plantronics. During the course of his practice, he has developed the legal strategy and conducted the litigation strategic planning for numerous clients, including the successful handling of negotiations and settlements. He also served as intellectual property counsel in litigation seeking cease & desist and other emergency relief, and licensing negotiation and settlements.
Significant Matters:
Developed several licensing partnerships, agreements and contracts primarily representing licensors. Negotiated licensing deals including pricing, terms, legal stipulations, territory limitations, duration, exclusive/non exclusive.
Managed intellectual property legal affairs involving trademarks, copyrights, licensing, anti-piracy, anti-counterfeiting, patents, enforcements, and trade secrets for large global clients in manufactured goods, technology, entertainment, publishing, fashion and food & beverage. Successfully obtained trademark registrations and Customs recordations.
Handled the strategy and legal affairs involving a large U.S. company's corporate identity theft in an international trademark counterfeiting scam. Successfully shut down scam operations and saved the company millions of dollars in damages and legal costs.
Served as co-counsel on a major international piracy and product counterfeiting case in the seafood industry. Handled the discovery and strategy in litigation against exporters and importers.
Represented large foreign corporation against another large foreign corporation in worldwide trademark dispute concerning apparel.
Served as lead counsel for a multi-national corporation with regional acquisition of CBS companies. Appointed to Board of Directors as acquiring company's general counsel. Defended hostile takeover bid by large foreign corporation.
Obtained a million dollar settlement in a patent infringement action involving automobile airbag technology.
Coordinated the obtaining of U.S. patents for companies after final rejections by U.S. Patent and Trademark Office. Patents successfully issued.
Developed and implemented anti-piracy and anti-counterfeiting programs to stop $20-50 million losses for fashion designers, including: criminal investigations, filing lawsuits, closing down illegal operations, filing international trademark applications and customs registrations, plus blocking illegal products from internet sales.
Provided legal direction and management of professional and support staff who handle trademark clearances, trademark prosecution, trademark investigations, trademark litigation, domain name registrations, domain name disputes, anti-cybersquatting, copyright clearances, copyright registrations, copyright litigation, rights of publicity and privacy.
