Lawyer Overview

Chuck Hungerford practices environmental, occupational health, and safety law, with an emphasis on the defense of agency enforcement actions and regulatory counseling.

Chuck has extensive experience assisting clients with environmental, health, and safety issues, including negotiating remediation and corrective action orders under Superfund and RCRA; representing clients in state and federal administrative enforcement of air, water, hazardous substances, and employee safety requirements; assisting clients in resolving air, water, and hazardous waste permit issues; performing environmental health and safety compliance audits; and providing regulatory compliance counseling concerning federal and California environmental health and safety statutes and regulations.

Chuck also has broad experience in real estate and land use matters. His land use practice emphasizes the identification of entitlements needed to develop proposed residential, commercial, and retail projects and evaluation of the environmental condition of proposed development sites.

Examples of Chuck's experience includes representation of:

• a pharmaceutical company in successfully addressing the environmental issues raised by a new cogeneration project using landfill gas to generate electricity

• a California city in resolving air permit issues raised by a new cogeneration project using digester gas to produce heat and electricity

• a California mining operation to resolve administrative enforcement initiated by the California Water Board

• an aerospace company in negotiations with DTSC concerning alleged hazardous waste violations

• a pharmaceutical company in the successful closure of several contaminated manufacturing sites

• an aerospace company in resolving and establishing financial assurances under federal and state hazardous waste statutes

• a Silicon Valley company in resolving environmental issues, including the presence of burrowing owls, raised by the construction of a new corporate headquarters

• institutional investors, lenders, and real estate developers in the evaluation of entitlements and environmental issues at more than 50 proposed major residential and retail developments throughout California, including development of two former military bases

• hotel owners and operators in the evaluation of entitlements and environmental issues at proposed hotel and resort locations and

• fishery organizations and environmental groups in litigation challenging the allocation of water by the Department of Interior.

At the start of his career, Chuck was an assistant counsel in the Office of Enforcement at the U.S. Environmental Protection Agency in Washington, D.C. During this time he worked with the Department of Justice to prosecute civil actions against major iron and steel companies and large coal-fired utilities for alleged violations of the federal Clean Air Act. He also participated in environmental briefings at The White House and on Capitol Hill.

Prior to entering private practice, Chuck was an assistant director in the environmental health and safety legal department of a major international pharmaceutical company. As in-house environmental counsel, he negotiated agreements with federal and state authorities resolving liability at several major Superfund sites; resolved enforcement actions related to alleged air, water, and hazardous substances violations; and worked with technical personnel to obtain operating permits under Title V of the Clean Air Act.

Chuck is a member of the State Bar of California and the American Bar Association.
