Lawyer Overview

Chuck Hungerford represents companies in matters involving environmental and land use laws. His representation includes defense during investigations and enforcement actions initiated by local, state, and federal environmental agencies and requests for air, water, and hazardous waste permits and permit modifications. Chuck also identifies the land use entitlements and resource agency permits needed to support proposed land use projects and the process for obtaining such approvals.

Chuck currently is working with manufacturing, pharmaceutical, and mining companies concerning the requirements of a wide variety of California and federal environmental laws, including California's evolving greenhouse gas regulations. He also is defending companies in administrative enforcement actions initiated by California agencies. Chuck works with major banks and investment groups to evaluate land use entitlements for proposed development projects and to identify the status of entitlements for existing collateral, including in the context of distressed loans.

At the start of his career, Chuck worked at the U.S. Environmental Protection Agency enforcing requirements promulgated under the federal Clean Air Act. Prior to entering private practice, Chuck was in-house counsel at a major pharmaceutical company focusing on implementation of RCRA and state equivalents and cleanup actions under CERCLA as well as health and safety issues. Currently, Chuck is a member of the City of Sunnyvale Planning Commission and has served as chair and vice chair of the commission. He is active in several pro bono matters, including work with The Nature Conservancy concerning emerging climate change issues and with The National Audubon Society concerning property issues.
