Lee Alexander has more than 25 years of legal experience in the fields of energy, regulatory, and environmental law. He focuses his practice on federal regulatory and transactional energy issues, including those of importance to natural gas and oil pipelines, storage facilities, and natural gas producers, as well as marketers and electric generators.
Lee concentrates on the representation of interstate natural gas pipelines and storage projects, natural gas and oil producers and marketers, local distribution companies, electric utilities and generators, and oil pipelines and shippers. This representation involves proceedings before the Federal Energy Regulatory Commission (FERC), the National Energy Board, the Surface Transportation Board, and other U.S. federal and state agencies. He also counsels clients with respect to all issues arising under the Natural Gas Act, Natural Gas Policy Act, Federal Power Act, and Interstate Commerce Act; transactional issues regarding the purchase, sale, transportation, and storage of natural gas and liquid hydrocarbons; and restructuring of state energy markets in a manner that allows all energy suppliers to compete on an equal basis.
Lee's current practice focuses extensively on the policy implications of natural gas regulation by FERC for his diverse energy clients. His area of concentration extends to all gas transportation pricing issues, including standards necessary to obtain approval to charge market-based rates, FERC's negotiated/recourse rate program, and flexible pricing for short-term firm, interruptible, and released capacity, as well as all industry operational and policy issues. Lee is also experienced in representing a variety of clients in pipeline proceedings around the country, including interstate natural gas pipelines, electric utilities and generators, and natural gas marketers, and is a nationally recognized speaker on natural gas policy issues.
Prior to joining Hogan & Hartson, Lee was a partner at a prominent D.C. law firm and served in a variety of positions at FERC, including Deputy Chief of Staff to Chairman Martin L. Allday. He was also Senior Legal Adviser to Chairwoman Martha O. Hesse, and was responsible for advising the chairmen and establishing FERC policy on all facets of interstate gas and oil transportation issues. He advised the chairmen on legal and policy issues relating to the natural gas, oil pipeline, and electric utility industries, and had primary responsibility for developing policies leading to the issuance of Order No. 636 and other rulemakings, rate design, and pipeline expansion issues. He also served as the primary liaison between the chairman's office and the commissioners, FERC staff, and other agencies. Before his positions in the chairman's office at FERC, Lee was appointed lead attorney responsible for all legal issues related to the 72 certificate applications that comprised the ""Northeast open season' process in the late 1980s.
Prior to his positions at FERC, Lee was a Senior Attorney Advisor and the assistant to the director in the Office of Proceedings (the functional equivalent of most agencies' General Counsel's Office) at the Interstate Commerce Commission (ICC). He provided legal and policy advice to the director on a wide range of issues facing the surface transportation industry. He also served as the assistant to the director of the Small Business Assistance Office of the ICC, where he represented small businesses.
Lee has chaired conferences and appeared on panels on behalf of the American Gas Association, Energy Bar Association, Northeast Gas Markets, Inc., Washington Energy Affiliates, Executive Enterprises Institute, The Canadian Institute, and the U.S.-Canadian Energy Outlook.
