Tim Fraelich's primary area of practice involves trademarks, including trademark infringement and dilution, trade dress protection, unfair competition, deceptive trade practices, and right of publicity law. Tim has more than 15 years of experience in global trademark clearance, brand development, portfolio management, and client counseling. He has represented clients in courts throughout the U.S. and before the United States Trademark Trial and Appeal Board (TTAB). Additionally, Tim frequently drafts and enforces post-employment noncompetition covenants designed to protect the confidential information and trade secrets of clients.

Tim was involved in recent cases concerning products such as banking services, beer, video games, drainage pipe, magazines, toys, cutlery, software, and a variety of other consumer products. He is primary outside trademark counsel for the H. J. Heinz Company and The J.M. Smucker Company, and he assists both companies in registering, protecting, and enforcing their numerous famous trademarks and logos. Tim is trial counsel for Smucker's in a trade dress infringement case that involves that company's Uncrustables product. He also recently represented Smucker's in a highly publicized case that was the first federal lawsuit involving "zombie" trademarks filed in the U.S.

Tim co-chairs the Firm's Trademark Practice and is a member of the International Trademark Association. He has been designated an "Ohio Super Lawyer" in the field of intellectual property litigation for 2005, 2006, and 2007. Tim sits on the board of the Greater Cleveland Council of the Boy Scouts of America.
