A partner in the Litigation Department, John F. Baughman has built a reputation assisting clients faced with complicated matters and crisis management situations. He has extensive courtroom experience, including twelve trials since he joined Paul, Weiss, and advises clients on all aspects of their most difficult contested matters.
Most recently, Mr. Baughman was co-lead trial counsel in a multimillion dollar dispute between a New York-based investment bank and a major U.S. steel producer. The case settled on the first day of trial with Mr. Baughman's client receiving more than it had asked for in its statement of claim.
In 2008, Mr. Baughman was co-lead trial counsel for Citigroup in the case Bondi v. Citigroup arising out of the collapse of Parmalat. In that case, Mr. Baughman and his colleagues defeated claims worth over 10 billion and obtained a jury verdict in favor of Citigroup for 364 million. This was the largest defense verdict in the country in 2008.
Mr. Baughman has particular expertise in complex cases involving fraud, the international banking system and the financial markets. Frequently, these matters involve overlapping civil, criminal and regulatory actions in a variety of jurisdictions. Through his work on such matters, Mr. Baughman has experience representing clients in cases brought by U.S. regulators, including the Department of Justice, the Securities and Exchange Commission, the Department of Labor, as well as various state attorneys general and the Manhattan District Attorney.
Many of Mr. Baughman's matters have been international and he spends a significant amount of time in the U.K. and Europe. In addition to dealing with U.S. regulators, he has advised clients in proceedings brought by regulators in the U.K., Europe and Hong Kong. As part of his international work, Mr. Baughman also has developed expertise with the Foreign Corrupt Practices Act ("FCPA") and has handled bribery investigations in Europe, Asia, and South America.
In other areas, Mr. Baughman has handled matters involving commercial disputes, false advertising, products liability and antitrust issues. He has tried cases in state and federal courts, as well as in arbitration proceedings. Some of his specific representations include:
- Representing executives of a major U.K. bank in an investigation of illegal payments made in violation of OFAC regulations.
- Representing the U.K. member of one of the big four accounting firms in an SEC investigation.
- Representing an executive of a U.K. defense contractor in an FCPA investigation conducted by the U.S. Department of Justice.
- Advising several U.K. gaming companies and their executives on U.S. law relating to online gambling.
- Representing a major U.S. bank in connection with investigations conducted by U.S. and Hong Kong regulators into alleged irregularities in a dual listed initial public offering.
- Conducting an internal investigation in the United States, the U.K. and Brazil on behalf of the audit committee of a major manufacturer faced with allegations of significant accounting fraud.
- Representing JPMorgan Chase in mutual fund "market timing" cases brought by the SEC, the NASD and the New York Attorney General, as well as related civil litigation.
- Representing the Official Creditors Committee of Armstrong World Industries in a trial concerning future asbestos-related liabilities.
- Representing CSG Systems at trial in a commercial dispute with AT&T.
- Representing Cantor Fitzgerald at trial in a commercial dispute with Reuters.
- Representing Castrol at trial in a false advertising dispute with Penzoil.
In recognition of his abilities, Mr. Baughman has been named the AmLaw Daily's "Litigator of the Week" (October 2008) and a "Future Star" by Benchmark Litigation (November 2008). Mr. Baughman was a note editor of the Michigan Law Review.
