Unpaid Overtime Overview

Get the Pay You Need for Overtime Work

The work that you perform over and above 40 hours is considered overtime. The general rule is that employers are required to pay time and a half for hours worked over 40. However, many employers try to make their employers work over 40 hours without this extra pay, and, in more serious cases, without pay at all.

We can help.

At the law firm of Marlin & Saltzman, LLP, we have been defending the rights of California workers since 1985. Our California employment law attorneys are aware of the unique struggles of slighted workers, especially in a struggling economy. We have exceptional knowledge and a track record of success with class-action employment lawsuits.

Misclassification

There are cases in which an employer will simply ask or tell an employee to work extra hours without pay. More commonly, though, employers will misclassify employees as "exempt" from overtime. Some of the common misclassifications include:

  • Manager or supervisor: By labeling you a "manager," an employer can expect you to get the job done no matter how many hours it takes. If you are called a "manager" or "supervisor," yet you do not manage or supervise anything in your work, you are probably misclassified.
  • Technical writer: Many writers in the technology field are misclassified. The most common sign of this misclassification has to do with whether you have any creative control over the writing, or if you are simply translating complicated technical language into layman's terms.
  • Contractor: Employers often use the classification "contractor" to avoid paying salary and benefits to employees, including overtime pay. If your job looks like a salary job in every aspect but your pay, especially overtime pay, you might have a misclassification case.
