Traffic Violations- DWI & Aggravated DWI Overview

If you are arrested for a traffic violation involving driving while intoxicated (DWI), you have two options: trial or plea. Considered a criminal offense, a DWI (also called DUI) conviction has serious consequences with the potential to alter your life. In addition to the loss of your license, you could incur expensive fines and possible jail time depending on the seriousness of the offense. By negotiating a plea bargain, you may be able to reduce the damages of a full DWI conviction (lower fines, hardship license, etc.).

While the penalties for drunk driving are strict, penalties for aggravated DWI are even harsher. Aggravated DWI occurs when you have .18 per centum or more blood alcohol content (BAC). The minimum BAC for a normal DWI charge is .08. The minimum fine for a first offense of aggravated DWI in New York is between $1,000 and $2,500 depending on the situation. You could also face jail time for up to a year, lose your driver's license for at least a year, lose your car registration, be on probation, and you may have to install an ignition interlock device at your own expense.
