Protecting Spokane Landlords’ Rights in the Eviction Process

When a tenant needs to be evicted, landlords must be careful to serve the tenant eviction notice correctly. Washington statute RCW 59.12.040 outlines the landlord’s responsibilities in these situations, and making a mistake can be costly.

Serving the Tenant Eviction Notice

Each tenant named on the lease must be served an eviction notice. If this is not done correctly, you may risk paying the tenant’s attorney’s fees and be prohibited from filing to evict the tenant. In fact, that is exactly what happened in a recent Washington case, Culpeper v. Jordan.

According to Washington laws, you can serve tenant eviction notices three ways:

  • Personal service – You can personally deliver the Notice to each tenant named on the lease.
  • Front door posting – You can post a separate copy of the Notice for each tenant on the front door of the property.
  • Postal mail – You can send each tenant a copy of the Notice through the U.S. Postal service.
