If you have a regular incoming paycheck, you may be able to qualify for Chapter 13 bankruptcy. Chapter 13 can address certain debts that cannot be discharged in Chapter 7, such as student loans, taxes and child support.
Student loans generally are not discharged under Chapter 13 your payments can be arranged so that you can stay on top of your monthly payments.
Taxes are sometimes discharged in bankruptcy. The Court will examine your taxes due for past years and determine the amount that must be repaid. Then the court will set a repayment plan over a period of years.
Child support cannot be discharged in bankruptcy; however, your payments for back child support can be arranged so that you can stay on top of your monthly payments moving forward. A repayment plan for back child support is established by the Bankruptcy Court generally on a three- or five-year plan.
