And, if you're not old enough to drink, you'll find yourself in more trouble when caught behind the wheel under the influence of alcohol.

In fact, there's a special law regarding DUI charges just for people who are under the age of 21. Known by many names ("Student DUI," "Underage DUI," and "Baby DUI"), it all leads to one thing – serious consequences. Found in A.R.S. § 4-244(34), the law creates severe penalties for drivers who are under 21 and drink and drive. Among these are up to 6 months in jail and loss of your driver's license for 2 years.

That, in a nutshell, is Student DUI – a serious crime that can have a big impact on your future as a Tempe ASU student.

What Are the Penalties for Student DUI?

Loss of driver's license. If you are under the age of 21 and are caught driving with any amount of alcohol in your system – even if you are below the 0.08 limit for blood alcohol content – you can lose your driver's license for two years. This will obviously affect your lifestyle and your ability to get to and from school and work.

Jail time. In Arizona, Student DUI is not just a "traffic ticket." It is a serious crime. The law says it's possible to get up to 6 months in jail, even for a first offense.

Felony charges. While most first-time Student DUIs are misdemeanor offenses, causing an injury in a crash while you were under the influence of alcohol could mean Felony DUI. So could being arrested for a second or third DUI, or being DUI while your license is suspended (even if your license is from another state). Known as "Aggravated DUI," a Felony is a serious blemish on your record, with the very real possibility that future employers will take you out of consideration when you're looking for a job or internship opportunity.
