The probate process is a legal mechanism for tying up the loose ends of a deceased person's life. This is done by settling the decedent's legitimate debts, including tax debts, and then transferring any remaining assets to his or her intended beneficiaries or intestate heirs.
The process begins by having an executor or administrator appointed to administer the estate. If no such person is named in the will, or if there is no will, a family member will generally be appointed by the probate court to serve as the decedent's personal representative and administrator of the estate.
The executor is then charged with completing four basic tasks: (1) identifying and valuing the assets of the estate; (2) notifying creditors and then settling any legitimate obligations of the decedent, selling off estate assets to do so, if necessary; (3) distributing any remaining estate assets to the decedent's named beneficiaries, if there is a will, or in accordance with Nevada's intestacy laws; and, (4) reporting and accounting to the court.
