Prior Conviction DWI Overview

Charged With a Second or Third DWI Offense? I Can Help.

A DWI charge in New Jersey is always a serious matter, but it is even more serious if you have any prior DWI convictions on your driving record. If you are convicted of a second or third DWI offense, you will get sentenced to prison and lose your driver’s license for years. To defend against these harsh consequences, you need an experienced attorney on your side.

I am John Tumelty, a South Jersey DWI defense lawyer and former prosecutor. I have been practicing criminal and traffic law in Cape May County and Atlantic County for more than 25 years, and I have been named a certified criminal trial attorney by the New Jersey Supreme Court. If you have been charged with prior-conviction DWI, call me today for a free consultation.

Call an Experienced Attorney to Defend Against Serious Penalties

If you are convicted of DWI a second time within 10 years of your first conviction, it will be considered a second offense. If you are convicted again within 10 years of your second conviction, it will be considered a third offense. The main penalties for prior-conviction DWI are:

  • Jail time: 48 hours to 90 days for a second offense; 180 days for a third offense
  • License suspension: Two years for a second offense; 10 years for a third offense
  • Fines: $4055 or more for a second offense; $6055 or more for a third offense

Additional penalties include alcohol classes, community service and mandatory use of an ignition interlock device once you regain your driver’s license. Depending on the facts of your case, I may be able to help you avoid or reduce these consequences. Contact me today to learn more.
