Overtime laws are complex and can be confusing, but several important factors are simple and easily understood. For instance, if you are not paid a salary, the law guarantees you overtime pay if you work more than 40 hours in a week. But, just because you are paid on a salary basis does not mean that you are not entitled to overtime. Approximately 70% of salaried workers are, in fact, entitled to overtime. Your employer can NOT fire you if complain about a lack of overtime pay. And your employer cannot pay you with comp time for overtime worked. Compensation must be done on a dollar basis.
