No-text Law Overview

TWD: A New Abbreviation for Reckless and Negligent Driving

On July 1, 2010, Michigan's no-texting-while-driving law, a.k.a. the no-text law, went into effect. This created a civil penalty or fine for any driver caught engaging in this activity. Legislators have also discussed adding criminal penalties for this offense in the future, similar in some ways to criminal drunk driving statutes.

While the no-text law is a step in the right direction toward making our roadways safer, it really doesn't change much for the people and families who've been harmed by these distracted drivers. Their need for experienced legal representation is still great.

Texting-While-Driving Accidents on the Rise

It's hard to be a safe driver when you aren't watching what you're doing. In 2009, the National Highway Traffic Safety Administration (NHTSA) found that distracted driving in all of its various forms was responsible for 20 percent of all injury crashes. Another study, conducted by researchers at the University of Utah, found that using a cellphone while driving, either to text or to speak with someone, delays a driver's reactions as much as having a blood alcohol concentration at the legal limit of .08 percent.

The bottom line here is that texting while driving is negligent, regardless of whether or not there is a law against it. Michigan's no-text law won't change that, and it won't stop people from doing it. It is, however, one more piece we can use to establish negligence and make our case for maximum recovery on your behalf.
