No Fault Divorce Attorney Overview

Just because you and your partner have decided to divorce, your separation and division of assets do not have to be bitter. Recently, the New York State Legislature's statute on no fault divorce took effect. The provisions of this statute allow divorce proceedings to be less contentious and do not require separation. The same divorce process does not have to address fault, such as cruel and inhuman treatment, adultery, abandonment or imprisonment.

The statute adds a provision to the domestic relations law that provides for a person to allege that there has been an irretrievable breakdown of the marriage for a period of six months or more. There are many reasons the state honors a divorce filing, but in a no fault divorce, only one partner needs to swear under oath that the relationship is irreparable, and this is not contestable.
