Divorce, or visitation problems, or child support collection and modification can often be overwhelming and full of complicated legal issues as well as a difficult emotional matter. When one or both spouses are military service members, it can seem even more daunting and complex.

Special Considerations in Military Divorce
Every divorcing couple has their own set of problems and priorities. These can be heightened in a military divorce, particularly if one or both spouses are deployed overseas, out of state or on temporary duty assignment. Understanding your rights is therefore critical to achieving a fair resolution. Common considerations in military divorces include:
- Health insurance benefits: Generally, a spouse not serving in the armed forces will lose health benefits unless he or she meets the 20-20 rule. This rule states that you are entitled to medical benefits only if your spouse served at least 20 years in the military and you were married for at least the same amount of time.
- Division of retirement funds: Under Texas law, both spouses can accrue retirement benefits regardless of the length of their marriage. Further, the retiring spouse may often be liable for paying benefits to the ex spouse from the point of retirement long after the divorce has been finalized by the court.
- Temporary spousal support: Military law requires that members of the armed forces support their spouse until a divorce has been finalized and now with recent changes in the law the state may require payment of spousal support or maintenance for specified periods of time after the divorce is final
- Child support and visitation: Visitation can be expensive if the divorcing parties live far apart. Possible solutions include scheduling longer, less frequent periods of visitation or removing the cost of travel from child support payments or even setting up an exchange point halfway between the parties to make the exchange of the child or children.
After reviewing the individual circumstances of your case, the legal team at Randy Wilson Law Offices will apply their in-depth knowledge of the law to help you reach an acceptable divorce agreement. They handle more than 100 military divorces and family law cases each year, and have what it takes to get it done right.
