Eric A. Rosen Overview
Eric A. Rosen practices in the areas of bankruptcy and creditors’ rights, out of court debt restructuring, business litigation, and commercial law. He has been helping companies and individuals resolve serious business and financial issues for twenty five years. He has authored chapters in leading publications pertaining to the treatment of secured creditors in bankruptcy cases, problems in determining disposable monthly income in bankruptcy cases since the 2005 amendments to the Bankruptcy Code, and the out of court restructuring of real estate loans.
In addition to successfully representing clients with financial difficulties in and out of court, Eric regularly advises secured and unsecured creditors in cases under Chapters 11, 7 and 13 of the Bankruptcy Code. He has substantial experience representing lenders providing post petition financing to debtors-in-possession, factors who lend against or purchase accounts receivable of debtors in cases under Chapter 11 of the Bankruptcy Code, and holders and purchasers of distressed real estate mortgages and loan portfolios in prepackaged Chapter 11 cases. He has served as counsel to petitioning creditors in involuntary bankruptcy cases, official creditors’ committees and creditors’ committee members in Chapter 11 cases, and counsel to court-appointed trustees in cases under Chapters 7 and 11 of the Bankruptcy Code. Eric has also participated in out of court workouts and collateral liquidations,and judicial enforcements of lien rights, on behalf of institutional and individual lenders.
Eric has been lead counsel in a broad spectrum of business litigation matters. He has won cases on behalf of plaintiffs and defendants, ranging from small arbitration proceedings, to bench trials and appeals in state court, to multi-week jury trials in federal court involving more than $35,000,000.
For almost fifteen years, Eric has been rated as having preeminent legal ability by Martindale Hubbell - the highest rating available - and as adhering to the highest ethical standards, by fellow attorneys and judges. He has been certified as a mediator by the United States Bankruptcy Court.
A member of The Florida Bar (Business Law Section) and the Palm Beach County Bar Association (Bankruptcy CLE and Lawyers for Literacy Committees), Eric is also a member of the Board of Directors of the Bankruptcy Bar Association for the Southern District of Florida. He is the Chair of the Pro Bono Committee for the West Palm Beach area, and oversees free monthly clinics on bankruptcy provided for the benefit of the public.
Eric regularly lectures on bankruptcy, insolvency, litigation and commercial law-related issues. Recent topics include: “Crossroads, the Intersection of Real Estate and Bankruptcy Law in Chapter 11 Cases” (Palm Beach County Bar Association, 2008); “What Every Collection Lawyer Needs to Know About Bankruptcy” (Palm Beach County Bar Association, 2009); “Ethical Obligations of Debtor’s Counsel” (National Business Institute, August, 2009); “Post Confirmation Modification of Plans in Chapter 13 Cases” (National Business Institute, November, 2010); “Protecting The Creditor's Rights During Bankruptcy Cases” (National Business Institute, December, 2010); "Debt Negotiation 101" (National Business Institute, July, 2011) and "Residential Loan Workouts and Modifications To Prevent Foreclosure" (National Business Institute, October, 2011). Eric recently served as moderator at a seminar at which bankruptcy judges addressed current issues, and taught the bankruptcy section of the course "Law In The Real World" at Florida Atlantic University's Honors College. He has also published a book entitled "Buyouts, Line by Line", which explains the contracts, and the clauses in them, that are often used when an owner of a company sells his or her interest back to the company, secured financing is involved in the purchase, and the seller remains with the company as an employee.
Eric is admitted to practice before all Florida state courts, all New York state courts, the United States District Courts for the Southern and Middle Districts of Florida, the United States District Courts for the Southern and Eastern Districts of New York, and the United States Court of Appeals for the Eleventh Circuit.
Eric received his undergraduate degree from Columbia University. He received his law degree from California Western School of Law, where he was awarded a merit-based academic scholarship, served as an Editor of the California Western International Law Journal, and won the school moot court competition.
