My antitrust and complex litigation experience has involved an extensive array of health care areas and specialties, including cardiac surgery, cardiology, chiropractics, dentistry, nephrology, neurosurgery, nursing, obstetrics-gynecology, orthopedics and radiology, among others.  I know the health care industry, the business of health care, its culture and its language.  I am extremely familiar with the needs of physicians and health care professionals facing litigation.

Why Do You Need an Attorney?

If you are facing litigation, the reality is that without legal representation you could lose your reputation, your hospital privileges, your license and, ultimately, your livelihood.

The Process

Litigation often begins when a hospital peer review committee sends out a letter stating its concerns.  A practitioner needs to seriously consider obtaining immediate legal representation.  That is because the initiation of the peer review process may quickly lead to a recommendation to restrict, suspend or revoke a practitioner’s clinical privileges at the hospital.   An evidentiary hearing and an appeal to the hospital board may follow.  Depending on the result, a lawsuit may be filed in state court.

If action is taken which adversely affects a practitioner’s privileges at one hospital that will have to be self-reported to other hospitals where the practitioner holds privileges and to the state regulatory board. 

Either as a result of the peer review process, or independently, the state regulatory board with authority over the practitioner may send out a complaint letter of its own and open a case.  At that point, a practitioner’s state license can be at stake.

When I am retained in any of these situations, I immediately respond to the fullest extent possible on behalf of my client, explaining the nature and intent of his or her actions.  I make every attempt to “nip matters in the bud”; I am a firm believer in the old adage that “an ounce of prevention is worth a pound of cure.” 

Resolution

Sometimes, though, the preceding approach is not enough.  In those situations, I bring to bear nearly four decades of actual litigation experience at both the trial and appellate levels in administrative and judicial arenas.  I am ready, willing and able handle the case at all stages of the litigation process.  That can include an evidentiary hearing in the peer review proceedings, an appeal before an appellate review panel of the hospital board, a separate trial before an administrative law judge of the state regulatory board, and a separate law suit in state or federal court.
